Please review the following terms and conditions relating to this reservation.


VACATION RENTAL CONTRACT TERMS AND CONDITIONS

 

Thank you for selecting Barry Ward Realty for your vacation rental.  We are in receipt of your payment as referenced on your confirmation.  Please check the information, dates and amounts carefully for accuracy.  Receipt of your payment and this confirmation obligates you to the terms and conditions listed below and the Rental Procedures Checklist.

 

AGENT: All cabins are privately owned and managed by Barry Ward Realty: 1122 Highway 4/PO Box 2961 Arnold, CA  95223.  209-795-6600, 800-535-2700, Fax 209-795-7622, www.barrywardrealty.com. Our office is located on the Northside of Highway 4 at Willow Street just past El Dorado Savings Bank.  Office Hours: 8:30am to 5:00pm (M-Sat; Sun 10-4).  After hour (emergencies ONLY): Janelle Ehret (209) 728-7203.

 

Minimum Age Requirement:

You must be at least 25 years old to reserve and check into our properties. A copy of a valid Drivers License will be required along with your signed Vacation Rental Contract. A co-signer will be considered on a case by case basis.

 

Reservations and Payments:

By making your reservation, you authorize Barry Ward Realty to charge your credit card accordingly. You must provide a valid credit card number to secure and confirm a reservation as well as for full security for any additional charges or damages during your stay. Barry Ward Realty reserves the right to change, cancel or move guest to a comparable cabin when deemed necessary due to circumstances beyond our control. Guests will be notified prior to arrival, when possible, of any change to reservation. At the time of your reservation, there will be a $250 initial payment to hold your reservation which we will apply to your rental fee. Payment can be made with a Visa, Master Card or E-Check. 3 weeks prior to your arrival, the remaining balance of your rental fee is due and we will charge the balance due with the form of payment used at the time of your reservation. Please sign and return your Confirmation and our Contract Terms and Conditions (4 pages) and the Winter Condition Advisory (1 page).

 

SECURITY DAMAGE INSURANCE:  This Security Deposit Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 will be charged to the credit card on file. If during your stay at one of our Rental Properties an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000, certain terms and conditions apply.  Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy, you may also go online www.vacationrentalinsurance.com/10sdi.  The Security Deposit Protection can be purchased when you book your reservation.   By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Barry Ward Realty any amount payable under the terms and conditions of the Security Deposit Protection.  Please contact CSA directly if you do not wish to participate in this plan or assignment.  PLEASE NOTE IF YOU OPT OUT OF THIS PLAN A CASH DEPOSIT EQUIVALENT OF THE COVERAGE LIMIT OF $3,000 IS REQUIRED.

 

Cancellation Policy: Cancellations must be made a minimum of three weeks prior to your arrival date for a full refund. A $100 processing fee will be charged for all cancellations. Cancellations inside of the three week period will be subject to the full rental amount UNLESS we can re-rent the cabin.

 

The number of guests may not exceed the number stated on our web site.  Renters are not to have gatherings, group parties, common meals, etc. exceeding the occupancy limits. Violation of this policy will result in additional charges for excessive “wear and tear”. Any exception to this must be approved in advance.  Unless otherwise stated, pets are not allowed. All cabins are non-smoking. If you need to smoke, please do so outside with great caution; even the slightest ember could start a wildfire.

 

Liability: Cabins are inspected prior to and after each use.  Renter is liable for any and all damages or additional costs incurred during their stay.  Renter shall save and hold harmless the agent and/or owner against any and all claims and liability including but not limited to weather (unless highway closure denies access to cabin), natural disasters, PG&E outages, injury or death to any person and/or damage to or loss of property in or about the premises.  Renters and/or their guests must obey all pertinent CC&R’s, local ordinances and laws. Due to the nature of the area, wifi, although advertised, is not guaranteed. There are no refunds for non-operable wifi.

 

Entry: Barry Ward Realty or Agents have the right to enter the unit at any time (1) for the purpose of making necessary or agreed repairs, improvements, for maintenance, or to supply necessary or agreed services (2) to verify that guests have complied with the terms of this agreement (3) show the property (with notice) to possible buyers (4) in case of emergency.

 

What to bring: Cabins are fully furnished and equipped as stated on our website including pots, pans, appliances, kitchen items etc.  PLEASE REMEMBER TO BRING SHEETS, PILLOWCASES AND TOWELS (pillows, blankets and bedspreads are provided) Check our website or call for bed sizes.  DURING THE FALL AND WINTER MONTHS, IT IS ADVISABLE TO CARRY A SMALL SHOVEL AND SNOW TIRE CHAINS.  A flashlight is always helpful.  If any personal property is left in the cabin, a charge may be applied for pick up and/or mailing.

 

ARRIVAL/CABIN KEYS: Check in time is 3:00pm. Please pick up your keys/packet at Barry Ward Realty, 1122 Highway 4, Arnold before 5:00pm. IF YOU EXPECT TO ARRIVE AFTER 5:00pm, YOUR RENTAL PACKET W/KEYS & MAP will be placed in the lock box under the light on Highway 4 side of our building.  Please lift the lid and look for the packet with your name on it. If unit is unsatisfactory upon arrival, DO NOT WAIT to contact us. If emergency maintenance or problems arise, please CALL OUR OFFICE IMMEDIATELY AT: 209 795-6600; after hours call: 209 728-7203. Please do not wait until check-out anticipating compensation.

 

DEPARTURE: CHECK OUT IS 12:00 NOON  Please leave the cabin as close to the way you found it as possible. Professional cleaning and sanitizing will be completed after your departure.  FAILURE TO COMPLETE ITEMS LISTED ON CHECK LIST CAN RESULT IN ADDITIONAL CHARGES!  PLEASE DROP OFF KEYS AT BARRY WARD REALTY UPON DEPARTURE  If our office is closed, drop keys in mail slot at bottom of front door.

 

PLEASE ABIDE BY THE FOLLOWING GUIDELINES DURING YOUR STAY. FAILURE TO COMPLY MAY RESULT IN ADDITIONAL CHARGES.

 

DURING YOUR STAY:

 

·         Number of overnight occupants may not exceed cabin limits as published.

·         Please bill all long distance calls to an outside account. Violations are subject to a $20.00 processing fee in addition to actual phone charges.

·         Be kind to the septic system.  Please put ONLY toilet tissue in the toilet. Stagger showers, run dishwasher & washer during non-shower times and do not put refuse down the drain. We ask you to conserve water due to the drought.

·         In the winter, please park 25 feet from center of road for snowplow access.

·         Please treat the cabin as if it were your own home.

·         Please secure the cabin when you leave.  Turn off lights, lower the heat and lock the doors and windows which helps save energy.

·         Please be very careful with matches, candles and fireplaces/wood burning stoves. No outdoor fires allowed.

·         Please clean BBQ after every use to discourage wild animals. Turn gas off to BBQ when finished. Gas left on may drain domestic propane tank.


REMEMBER…CHECK OUT IS 12:00 NOON…TURN OFF LIGHTS, LEAVE HEAT/GAS STOVES ON LOW TEMPERATURE. To avoid additional charges, please complete the following prior to your departure. Minimum additional service fee is $25.

 

UPON DEPARTURE:

 

·         Pet friendly cabins only: There is a $50 per pet charge; please call our office at the time of your reservation indicating the number of pets you will have staying at the cabin with you. A penalty of $300 will incur if the number of pets you bring doesn’t match the number of pets originally stated. Pet Waste: In order to avoid an additional minimum cleaning charge of $50, please be sure to clean up after your pet, especially any waste in the yard. We also ask that you take appropriate measures to ensure that there is no excessive barking while you are away from the cabin.

·         Please return all furniture and objects to their original positions.

·         Please wash your dishes and put them away. If housekeeping arrives to a dishwasher to unload, the guest will be charged $10.

·         Please make the beds. Don’t forget to take your linens & towels home! If you rented linens & towels: Follow the instructions that were included with your items.

·         Please sweep and vacuum major spills if necessary, wipe up spills and clean up as needed.

·         Please bag and remove all refuse to outside trash containers. Secure the lids and refuse containers to discourage animals. Do not put trash in neighbors' containers! Any excess trash over 2 cans needs to be taken to the Avery Transfer Station; there is no dumping fee and directions are provided at check-in. If excessive garbage is left, there is a $25 disposing fee. IMPROPER DISPENSING OF GARBAGE IS A MAJOR ISSUE IN THE MOUNTAINS!

·         Please remove all your food and supplies from the cupboards and refrigerator.

·         Please leave the kitchen stove and oven as you found them.

·         Please remove ashes from the fireplace/woodstove IF COOL, use only the ash can provided and leave on hearth.

·         Please replace firewood for next tenants.

·         Please check under beds, in closets and dressers for your clothes, battery chargers, power supply cords, electronic games, CD's and other personal belongings.

·         Please turn off all appliances, lights and ceiling fans, leave heat on low temperature setting. (50° in winter)

·         Please close and secure all windows and doors.

·         Please fill out the cabin report card. WE SEND THESE TO THE OWNERS SO THEY CAN IMPROVE THEIR CABIN FOR YOUR NEXT VISIT.

·         Please return the keys and your cabin report card to Barry Ward Realty no later than 12:00 NOON.
